Terms of Service
Please read these terms carefully. By creating an account or making a booking on Catalani Locations, you agree to be bound by this agreement in full.
What Catalani Locations Does
Catalani Locations operates an online marketplace that connects property owners (“Hosts”) who wish to rent out their spaces with individuals and companies (“Renters”) seeking locations for events, productions, meetings, and other approved activities. We facilitate the connection, booking, and payment process — but we are not a party to the rental agreement itself.
Hosts and Renters are independent parties who bear responsibility for their own conduct, the condition of spaces, compliance with applicable laws, and proper insurance coverage. Catalani Locations does not own, manage, or control any listed location.
Definitions
- “Platform” means the website catalanilocations.com, its mobile applications, and all related services.
- “Host” means any registered user who lists a Location on the Platform for rental.
- “Renter” means any registered user who books a Location through the Platform.
- “User” means any person who accesses or uses the Platform, including both Hosts and Renters.
- “Location” means a physical property or space listed by a Host on the Platform.
- “Booking” means a confirmed reservation of a Location by a Renter, accepted by a Host.
- “Booking Price” means the total rental fee set by the Host for a Booking, before Platform Fees.
- “Platform Fee” means the fee charged by Catalani Locations to each party — currently 9% from the Renter and 9% from the Host — for use of the Platform and its services.
- “Listing” means the public-facing page describing a Host’s Location, including photos, pricing, rules, and availability.
- “Content” means any text, photos, video, or other material submitted by a User to the Platform.
Eligibility & Account Registration
Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use this Platform. By registering, you represent and warrant that all information you provide is accurate, current, and complete. Businesses and entities may register provided they authorize a legal representative to agree to these terms on their behalf.
Account Responsibilities
- You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must promptly notify us of any unauthorized use of your account at support@catalanilocations.com.
- You may not create multiple accounts, share accounts, or create an account on behalf of another person without their authorization.
- We reserve the right to refuse registration, suspend, or terminate accounts at our discretion.
Identity Verification
We may require Users to provide government-issued identification or other verification documents as a condition of using certain features. Failure to provide requested verification may result in restrictions on your account. Verification does not constitute an endorsement of any User.
The Platform’s Role
Catalani Locations acts solely as a technology intermediary. We provide the tools for Hosts to list Locations and for Renters to discover and book them. We do not:
- Own, manage, operate, or control any Location listed on the Platform.
- Warrant the accuracy, completeness, or condition of any Listing.
- Guarantee that Hosts or Renters will fulfill their obligations.
- Act as an insurer, surety, or guarantor for any Booking or transaction.
- Assume liability for the actions, omissions, or conduct of any User.
The rental relationship is solely between the Host and the Renter. Any disputes arising from a Booking are primarily the responsibility of the parties to that Booking, though we offer a structured dispute-resolution process as described in Section 12.
Host Terms & Responsibilities
Listing Requirements
By listing a Location, you represent and warrant the following:
- You are the owner of the Location or have the explicit written authorization of the owner to list and rent it.
- Listing and renting the Location does not violate any lease agreement, HOA rules, mortgage agreement, or applicable law.
- You hold or will obtain all permits, licenses, and approvals required by local zoning, fire, health, and other regulations before accepting any Booking.
- You are responsible for collecting and remitting all applicable taxes (sales tax, occupancy tax, etc.) associated with rental income. Catalani Locations does not collect or remit taxes on your behalf unless required by law.
- All Listing details — including photos, description, amenities, capacity limits, rules, and pricing — are accurate and kept up to date.
- You will not discriminate against Renters on the basis of race, color, religion, national origin, sex, sexual orientation, gender identity, disability, familial status, or any other characteristic protected by applicable law.
Host Obligations During a Booking
- Provide Renters with all access information no later than 24 hours before the Booking start time. Failure to do so may entitle the Renter to a full refund.
- Ensure the Location is in the condition described in the Listing at the time of the Booking.
- Respond to Renter inquiries and concerns promptly — ideally within 4 hours during the Booking period.
- Conduct or designate a walk-through at the conclusion of each Booking and document any damages within 24 hours of the Booking’s end.
- Maintain the Location in compliance with applicable health and safety standards.
Host Cancellations
Hosts are expected to honor confirmed Bookings. Host-initiated cancellations harm Renters who have made plans based on confirmed reservations. Repeated cancellations may result in account suspension, removal of your Listing, or other penalties at our discretion. Please refer to our Cancellation Policy page for specific terms.
Pricing
Hosts set their own Booking Price. The price you set must be your best available rate — you may not offer the same Location at a lower price through another channel without offering that same rate on Catalani Locations. We reserve the right to display estimated total prices inclusive of Platform Fees to Renters at all times.
Renter Terms & Responsibilities
Booking Requests
When you submit a Booking request, you are making a binding offer to rent the Location under the terms set by the Host. A Booking is confirmed when the Host accepts your request. At that point, payment will be captured from your account. You are responsible for reading all Listing details, rules, and restrictions before submitting a request.
Renter Obligations
- Use the Location only for the purpose and type of activity disclosed in your Booking request. Misrepresenting the intended use is grounds for immediate Booking termination without refund.
- Comply with all Host rules regarding capacity, noise, smoking, alcohol, pets, parking, and any other restrictions stated in the Listing.
- Treat the Location, its furnishings, and surrounding areas with care and respect. You are liable for any damage caused by you or your guests that exceeds normal wear and tear.
- Leave the Location in the same condition as you found it, unless a cleaning service is included in the Booking.
- Do not exceed the maximum capacity stated in the Listing.
- Do not sublet or reassign your Booking to any other party.
- Comply with all applicable laws, including noise ordinances, permitting requirements, and laws governing the intended use of the Location.
- Ensure that you and all attendees are of legal age for any activities involving alcohol.
Damage Liability
Renters are financially responsible for any damage to a Location, its contents, or surrounding property caused during a Booking. Damage claims must be reported by the Host within 24 hours of the Booking’s end. We will review the claim and may facilitate resolution; however, Catalani Locations does not guarantee coverage of damages and is not liable for amounts not collected. You are encouraged to carry event or production insurance (see Section 11).
Fees & Payments
Payment Processing
All payments on the Platform are processed by a third-party payment processor. Full payment (Booking Price + Renter Platform Fee) is charged at the time a Booking is confirmed. Catalani Locations holds funds in escrow until the Booking is completed, at which point the Host’s payout (Booking Price minus Host Platform Fee) is initiated within 3–5 business days.
Additional Fees
- Overtime: If you use a Location beyond the agreed end time, you may be charged at the Host’s hourly rate, billed in 30-minute increments, plus applicable Platform Fees.
- Over-Capacity: Exceeding the stated capacity limit may result in additional charges at the Host’s discretion or Booking termination.
- Damage Claims: Amounts owed for damages will be charged to the Renter’s payment method on file.
Fee Changes
We reserve the right to modify Platform Fees at any time. Changes will be communicated with at least 30 days’ notice via email and site notification. Fee changes do not affect Bookings already confirmed prior to the effective date of the change. For a full overview, please visit our Fee Overview page.
Taxes
Hosts are solely responsible for determining and remitting any applicable taxes on rental income. Catalani Locations does not provide tax advice. We recommend consulting a qualified tax professional regarding your obligations in your jurisdiction.
Cancellations & Refunds
Cancellation terms are governed by our dedicated Cancellation Policy page, which is incorporated into this Agreement by reference. In the event of a conflict between a specific cancellation term on that page and this Agreement, the Cancellation Policy governs as to cancellation matters.
- The Renter Platform Fee (9%) is non-refundable in all cases once a Booking is confirmed.
- Cancellation terms vary by Listing. Hosts select their cancellation tier (Flexible, Moderate, or Firm) and this is prominently displayed on each Listing before booking.
- Bookings are not officially cancelled until you receive a written cancellation confirmation from Catalani Locations.
- Catalani Locations has final authority over all disputed cancellations.
Extenuating Circumstances
We may, at our sole discretion, provide exceptions to standard cancellation terms in the event of documented emergencies, natural disasters, governmental orders, or other extraordinary events that make a Booking impossible. Such decisions are made on a case-by-case basis and are not guaranteed.
Community Standards & Prohibited Conduct
- Act honestly and in good faith in all interactions
- Communicate through the Platform messaging system
- Process all payments exclusively through the Platform
- Respect the privacy and personal safety of other Users
- Comply with all applicable laws and regulations
- Report violations to Catalani Locations promptly
- Transact outside the Platform to avoid fees
- Provide false or misleading information
- Engage in discriminatory conduct of any kind
- Harass, threaten, or harm other Users
- Use the Platform for illegal purposes
- Create fake accounts or manipulate reviews
- Reverse-engineer or scrape the Platform
Off-Platform Transactions
Arranging or completing payment for any Booking outside of the Platform is a serious violation of this Agreement and may result in immediate account termination. Off-platform transactions are ineligible for any dispute resolution, refund, or damage protection offered by Catalani Locations. We actively monitor for off-platform solicitation and will act accordingly.
Reviews & Feedback
We encourage honest, accurate reviews from both Hosts and Renters following completed Bookings. Reviews must reflect your genuine first-hand experience. We prohibit retaliatory, defamatory, or fraudulent reviews. We may remove any review that violates these standards at our sole discretion, without obligation to provide a reason.
Content & Listings
License You Grant Us
By submitting Content to the Platform (including photos, text descriptions, reviews, and other materials), you grant Catalani Locations a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display that Content in connection with operating and promoting the Platform. You retain ownership of your Content.
Content Standards
All Content must be accurate, lawful, and not infringe on any third-party rights. You represent that you own or have the necessary rights to all Content you submit. We reserve the right to remove any Content that violates this Agreement or that we find objectionable, without notice or obligation to provide a reason.
Listing Accuracy
Hosts are solely responsible for keeping all Listing details current and accurate, including pricing, availability, photos, rules, and any material conditions that would affect a Renter’s decision to book. Materially misleading or inaccurate Listings may result in cancellation of associated Bookings, refunds to Renters, and suspension or removal of the Listing or account.
Disclaimers, Limitation of Liability & Indemnification
Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CATALANI LOCATIONS MAKES NO WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING IS ACCURATE, SAFE, OR SUITABLE FOR YOUR INTENDED PURPOSE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CATALANI LOCATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR ANY BOOKING, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL PLATFORM FEES PAID TO US IN CONNECTION WITH THE SPECIFIC BOOKING AT ISSUE, OR (B) ONE HUNDRED DOLLARS ($100).
Indemnification
You agree to indemnify, defend, and hold harmless Catalani Locations and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of this Agreement; (b) your Content; (c) your use of the Platform; (d) any Booking, including your conduct as a Host or Renter; or (e) your violation of any law or the rights of any third party.
Insurance
Catalani Locations does not provide insurance coverage for any Host, Renter, Location, or Booking. We strongly encourage all Users to obtain appropriate insurance coverage before listing or booking a Location.
- Hosts should verify that their existing homeowner’s, renter’s, or landlord’s insurance covers short-term commercial rental activity. Many standard policies do not. You may need a separate commercial or event venue policy.
- Renters should consider purchasing event liability insurance, production insurance, or a short-term activity policy that covers the type of activity being conducted and provides general liability coverage for bodily injury and property damage.
- Some Hosts may require proof of insurance as a condition of their Listing. It is the Renter’s responsibility to obtain and provide this documentation before the Booking start time.
Catalani Locations is not liable for any losses arising from your failure to obtain adequate insurance coverage.
Dispute Resolution
Between Users
We encourage Hosts and Renters to resolve disputes directly and in good faith. If you cannot reach a resolution within 48 hours of the dispute arising, you may escalate the matter to Catalani Locations by contacting support@catalanilocations.com with full documentation. We will review the matter and may facilitate a resolution, but our role is that of a mediator, not an arbitrator, except as provided below.
Disputes and any supporting evidence must be submitted within 72 hours of the Booking’s end. Catalani Locations has final say in all disputes regarding Platform Fee refunds or escrow funds held by us. Our decisions regarding funds under our control are final and binding.
Between You and Catalani Locations
Any dispute, claim, or controversy arising from or related to this Agreement or your use of the Platform shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with the arbitration conducted in English. Each party waives any right to a jury trial. You also waive any right to bring or participate in a class action lawsuit or class-wide arbitration against Catalani Locations.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Intellectual Property
All intellectual property in the Platform — including the Catalani Locations name, logo, website design, software, and proprietary content — is owned by or licensed to Catalani Locations. Nothing in this Agreement grants you any right to use our trademarks, trade names, or branding without our prior written consent.
You may not copy, reproduce, distribute, modify, or create derivative works of any Platform content without our express written permission. Automated scraping, data mining, or collection of Listing data without authorization is strictly prohibited and may result in legal action.
Privacy
Your privacy matters to us. Our Privacy Policy describes how we collect, use, and protect your personal information and is incorporated into this Agreement by reference. By using the Platform, you consent to the data practices described in our Privacy Policy.
Your full name and address as a Host will not be disclosed to Renters until a Booking is confirmed. Renters’ identity information may be shared with Hosts as necessary to fulfill a confirmed Booking. We do not sell your personal data to third parties for marketing purposes.
Termination
You may close your account at any time by contacting us. Closing your account does not cancel active Bookings or relieve you of financial obligations arising from confirmed Bookings. Obligations that survive termination include payment obligations, indemnification, intellectual property terms, and the dispute resolution provisions.
Catalani Locations may suspend or terminate your account, remove your Listings, or cancel Bookings at any time, with or without notice, for any reason, including but not limited to:
- Breach or violation of any provision of this Agreement.
- Conduct that is harmful, illegal, fraudulent, or a risk to others.
- Failure to respond to communications within a reasonable time.
- Off-platform transaction activity.
- Actions that damage the reputation or integrity of the Platform.
- Request or requirement of applicable law or legal process.
Modifications to This Agreement
We may update this Agreement from time to time. When we make material changes, we will notify you via email and/or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised terms.

Governing Law & Jurisdiction
This Agreement is governed by the laws of the State of Florida. Any legal action not subject to arbitration under Section 12 shall be brought exclusively in the state or federal courts located in Lee County, Florida, and you irrevocably consent to the personal jurisdiction of those courts.
If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision.
